"All Television Media" and "All TV" shall mean the exhibition of a motion picture by all the Linear forms of television broadcast and/or the now known or the hereafter devised whether such programming is transmitted via wires, wireless, cables, satellite, or any other communication channels, including , without limitation Free TV, Basic Cable TV, Pay TV, Subscription TV Pay-Per-View, Video On Demand, and other on-demand services, but not including (a) any technology or transmission that invites or enables viewers to purchase a permanent download or copy of a motion picture, or (b) so –called "Pod-casting." (a)"Free TV" shall mean and include the television broadcast of a performance of a motion picture over the facilities of television broadcast networks and local television broadcast stations (not cable transmissions or "CATV" transmissions) which furnish such broadcast without charge to the viewer and which are received by and exhibited on a television broadcast receiver or other similar viewing device.


"Basic Cable TV" shall mean the Linear exhibition and performance of a motion picture by means of cable television systems and facilities now known or hereafter devised , whether such programming is transmitted via wires, cables, satellite, or any other communication channels, for which members of the public may pay for the transmission service provided by the cable system (i.e. a basic tier of programming).


"Pay/Subscription TV" shall mean the Linear exhibition and the performance of a motion picture to a television set or other viewing device , by any technology now known or hereafter devised (a) that the ultimate viewer receives upon payment of a periodic subscription fee for a premium tier of programming (over and above a basic fee for a basic tier of programming), (b) whether transmitted via wires, wireless, cables, satellite, or any other communication channels,(c) that is available as part of a forward", "rewind" or similar functionality, but (d) not including any technology or transmission that invites or enables viewers to purchase a permanent download or copy of a motion picture, or so-called "Pod-casting."


"Pay-Per-View/Video-On-Demand" shall mean the Linear exhibition and the performance of a motion picture to a television set or other viewing device, by any Linear technology now known or hereafter devised (a) that the ultimate viewer receives upon payment of a separate fee for the ability to view a motion picture or a program selection, (b) whether such is transmitted via wires, wireless, cables, satellite, or any other communication channels, ( c) that is available as part of regularly-scheduled programming or "on-demand" basis, with or without "pause", "fast-forward", "rewind" or similar functionality, but (d) not including any technology or transmission of a motion picture that invites or enables viewers to purchase a permanent download or copy of a motion picture, or so-called "Pod-casting."<


"Non Linear" shall mean any device or media designed for the passive viewing of a motion picture of a motion picture in a predetermined sequence, the order, outcome and the contents of which cannot be selected or altered by the viewer other than through the performance of now-existing VCR or DVD functions ( e.g. stop, play. Fast forward, rewind, pause, etc.). The inclusion of "chapter stops" or other addressable locator codes of any kind on the applicable storage device , or the inclusion of expository material (e.g. interviews with the directors, film makers, or cast members)contained on a separate audio-visual track, shall not be deemed to constitute non- Linear manipulation.


"Videogram(s)" shall mean and include all audio visuals devices, now known or hereafter devised (whether wired or wireless) intended for personal, non-commercial use for the Linear viewing of a motion picture, including without limitation, video discs ("DVD"), video cassettes, video downloads (e.g. through Itunes music service for reproduction on the Ipod), and any other Linear technology or transmission whereby a consumer may purchase a permanent download or copy of motion picture for personal, non-commercial use.


“Common Carriers” shall mean and include the exhibition of a motion picture on any commercial carrier such as commercial airlines, trains, ships, and buses.


“Internet” use shall mean the right to reproduce the Composition(s) as embodied in the Production in Linear exhibitions of a  motion  picture through the publicity accessible worldwide system of interconnected computer networks (including private communications networks such as virtual private networks  “VPN”) solely for personal, non-commercial use. Such right shall include so-called “streaming” delivery and /or “downloadable “ formats, but shall not include (a) any other rights to download an audio-only version of the Composition(s), whether digitally  or otherwise, or (b) any technology or transmission that invites or enables viewers to purchase a permanent download or copy of a motion picture, or (c) so-called “Pod-casting.”


“Theatrical Exhibition” shall mean and include the Linear exhibition of a motion picture to an audience ( whether or not admission is charged ) in theaters and in other places where motion pictures are customarily exhibited by means, method, or device (including telecast or cable systems), provided however that any performance or exhibition of a motion picture defined elsewhere herein shall not be deemed included in the foregoing definition.

“Art House Theaters”


Small venues of 50 or less persons, ie: Bars / Schools.

“Non-theatrical Exhibition”


shall mean the exhibition  of  the Production to non-theatrical audiences in private theaters or private places, in markets including but  not limited  to hotels, hospitals, drilling platforms, military, governmental and diplomatic installations,  Red Cross, Salvation Army, marine and industrial installations,  prisons, schools, colleges, libraries, societies, clubs, bars, and discotheques.


“All Media Excluding Theatrical”


shall mean the exploitation of a motion picture in any and all Linear media now Known or hereafter devised , including without limitation, All Television Media, Internet, Non-Theatrical, Common Carriers, and Videograms(s), however specifically excluding Theatrical Exhibition.


“In-context Promos”

shall mean the right to use the Composition(s) as embodied in the Production, in promotions to advertise and publicize the Production provided that (a) such promotions shall be limited to the actual footage from the Production that contains the Composition(s) be extracted from the Production, or used in any other manner than as expressly authorized herein, and (c) the exhibition of such promotions shall be limited to the Licensed Media set forth in the License.

“Out of -context Promos”

shall mean the right to use the Composition(s) as embodied in the Production, in promotions to advertise and publicize the Production, however (a) such promotions shall be NOT be limited to the actual footage from the Production that contains the Composition(s.  The exhibition of such promotions shall be limited to the Licensed Media set forth in the License.

A cue sheet

is required if you plan to distribute your production via any means of public performance, ie: Television / Theatres / Trade shows etc.
